Your statutory rights come first
Consumer law overrides anything below.
If the service is faulty, not fit for purpose, or not as described, you have rights under the Australian Consumer Law that this policy cannot reduce — including a repair, replacement or refund depending on whether the failure is major.
New Zealand consumers have equivalent rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. United States consumers have the rights given by their state law and by the card scheme rules.
Nothing below limits those rights. This policy explains what we do voluntarily, on top of them.
Free accounts
Nothing to cancel, nothing to refund.
Looking for work on Kwirl is free and always will be. Closing a free account stops nothing being charged, because nothing was.
Cancelling a paid plan
Cancel any time, keep the plan to the end of the period.
Cancel in Settings, Billing. Cancellation takes effect at the end of the current billing period, and you keep full access until then. There is no cancellation fee and no lock-in on monthly plans.
Annual agreements run to their stated end date unless the contract says otherwise. Where an annual agreement carries a notice period it is stated in the order form, and it is never longer than 30 days.
Refunds we give
Fourteen-day change of mind, plus faults and billing errors.
- Change of mind: a full refund of a first paid period if you ask within 14 days of the first charge and have not posted a role or sent sourcing messages.
- Billing error: any duplicate charge, wrong plan or wrong amount is refunded in full, whenever it is found.
- Outage: if a paid plan is materially unavailable for more than eight hours in a calendar month, we credit that month on request.
- Fault: where a failure is major under consumer law, you choose between a refund and a resupply.
- Downgrade mid-period: the unused portion of the higher plan is credited to your account and applied to the next invoice.
Refunds we do not give
Unused time on an annual term, and accounts closed for cause.
We do not refund the remainder of an annual term because you stopped using it, and we do not refund a period where an account was closed for a breach of the Terms or the Acceptable Use Policy.
We do not refund a paid period because a role did not fill. Kwirl sells access to the tools and the market, not a hiring outcome.
How to ask, and how long it takes
Email billing. Ten business days.
Email billing@kwirl.com.au with the account name and the invoice number. We acknowledge within two business days.
Approved refunds are returned to the original payment method within ten business days. Card issuers can take another few days to show it. Where the original method has expired we arrange a bank transfer.
Disputes that we cannot resolve can be taken to your local consumer body: the ACCC or your State fair trading office in Australia, the Commerce Commission or Disputes Tribunal in New Zealand, or your State Attorney General in the United States.
